BAYTOWN TRUCK ACCIDENTS

Baytown Truck & 18-Wheeler Accident Lawyer

Maida Law Firm represents people hurt in 18-wheeler and commercial truck crashes in Baytown, from our Houston office on the Southwest Freeway; we have no Baytown office. Baytown’s truck traffic runs on I-10 and SH 146, a highway TxDOT lists on the Texas Highway Freight Network and is studying because of fatal and incapacitating crashes.

A Baytown truck claim is filed in Harris County, or in Chambers County when the crash happened on the Chambers side of the city, and must be filed within two years (Tex. Civ. Prac. & Rem. Code § 16.003). The consultation is free: call (713) 785-9484.

The short version

  • This page is about 18-wheeler and commercial truck crashes in Baytown. For other injury claims, see our Baytown personal injury page; for the full practice, our Houston truck & 18-wheeler accident page.
  • Baytown’s trucks run on I-10 and SH 146. TxDOT lists SH 146 on the Texas Highway Freight Network and is studying it because of fatal and incapacitating crashes.
  • The freight comes from the ExxonMobil Baytown complex (3,400 acres on the Ship Channel), TGS Cedar Port (about 15,000 acres) and warehouses on the I-10 frontage near the Barbours Cut and Bayport terminals.
  • Baytown spans Harris and Chambers counties: the crash location decides the courthouse. Baytown police investigate inside the city; the report comes from the Records Division at 3200 N. Main Street or TxDOT online.
  • Two years to sue (§ 16.003); six months notice for a city or county vehicle (§ 101.101); no recovery above 50% responsibility (§ 33.001).
BAYTOWN CORRIDORS

Where do 18-wheeler crashes happen in Baytown?

Mostly on I-10 and SH 146, the two freight routes that serve Baytown’s refineries, industrial parks and warehouses. Two reported crashes show the pattern: two 18-wheelers in a six-vehicle crash at I-10 and Thompson Road on September 17, 2026, and an 18-wheeler left hanging off SH 146 at West Main on August 6, 2025.

SH 146. TxDOT’s study of SH 146 from north of I-10 at Langston Road to north of Ferry Road, through Baytown and Mont Belvieu, lists two reasons: “Safety concerns due to fatal and incapacitating crashes” and heavy vehicle traffic on a roadway “designated as part of the Texas Highway Freight Network” (TxDOT, SH 146 feasibility study). On August 6, 2025, an 18-wheeler was left hanging off southbound SH 146 at West Main; the Baytown Police Department said the driver was taken to hospital as a precaution (ABC13, August 6, 2025).

I-10. On September 17, 2026, a crash involving two 18-wheelers, three cars and a motorcycle shut down the intersection of Thompson Road and I-10; no injuries were reported and Baytown police opened an investigation (ABC13, September 17, 2026). We do not know what caused either crash and do not speculate about it.

Why the trucks are here. The ExxonMobil Baytown complex, open since 1920, spans 3,400 acres along the Houston Ship Channel with a workforce of about 7,000 people (ExxonMobil). The Baytown Economic Development Foundation lists TGS Cedar Port Industrial Park at about 15,000 acres with more than 25 million square feet of industrial and warehouse space, and the Port 10 Logistics Center on the I-10 frontage close to the Barbours Cut and Bayport container terminals (Baytown EDF). A crash involving a tanker, a container chassis or a flatbed from one of these sites can involve the driver, the motor carrier, the shipper and the facility’s contractors, each with different insurance.

AFTER A BAYTOWN CRASH

What happens after an 18-wheeler crash in Baytown?

Inside the city, the Baytown Police Department investigates, and its Crash Reconstruction Team handles major crashes. The report comes from the Records Division at 3200 N. Main Street or online through TxDOT’s crash report system. The truck’s logbook, engine data and dashcam belong to the carrier, so a preservation letter goes out in the first days.

The report. The City of Baytown’s crash-report page directs people to the Records Division at the police station, 3200 N. Main Street, open Monday to Friday, 8 a.m. to 5 p.m., and to TxDOT’s online Crash Report system (City of Baytown). The Texas Peace Officer’s Crash Report (CR-3) is the starting point for identifying the drivers, vehicles and witnesses involved.

Treatment. Houston Methodist Baytown Hospital, 4401 Garth Road, describes itself as a full-service acute care hospital serving Harris, Chambers, Liberty and surrounding counties (Houston Methodist); Houston’s two Level I trauma centers are in the Texas Medical Center. Keep every record from the first visit on: a gap in treatment is the first argument an insurer makes.

The court. Baytown lies in both Harris and Chambers counties. A lawsuit over a crash on the Harris County side is ordinarily filed in the civil district courts at the Harris County Civil Courthouse, 201 Caroline Street, Houston; a crash on the Chambers County side goes to the Chambers County courthouse in Anahuac. We confirm the county from the crash location in the first week.

The rules. A commercial driver works under federal hours-of-service limits, post-crash drug and alcohol testing and minimum insurance of 50,000 for general freight and up to ,000,000 for bulk hazardous cargo. How those rules work, and what they mean for the value of a claim, is set out on our Houston truck and 18-wheeler accident page and our truck accident settlement page. For other injury claims in the city, see our Baytown personal injury page.

COMMON QUESTIONS

What do people ask about Baytown truck accidents?

From the Baytown Police Department Records Division at 3200 N. Main Street, Monday to Friday, 8 a.m. to 5 p.m., or online through TxDOT’s Crash Report Online Purchase System, where a regular copy costs and a certified copy . If the Harris County Sheriff’s Office or DPS responded instead, the report is purchased the same way through TxDOT.

Often several parties: the driver, the motor carrier that employs or contracts the driver, the shipper that loaded the cargo, and sometimes the maintenance contractor. A carrier hauling bulk hazardous materials must carry at least ,000,000 in coverage, and ,000,000 for oil and most other hazardous materials (49 C.F.R. § 387.9). Who is at fault depends on evidence, not on who owns the plant.

It depends on where the crash happened, or where a defendant is based. Baytown spans Harris and Chambers counties, so a crash on I-10 or SH 146 near the county line needs its exact location checked. Harris County cases go to the Civil Courthouse at 201 Caroline Street in Houston; Chambers County cases go to the courthouse in Anahuac.

Generally two years from the date of the crash under Tex. Civ. Prac. & Rem. Code § 16.003(a), or two years from the date of death in a fatal case. If a City of Baytown or Harris County vehicle was involved, written notice is required within six months under § 101.101, and the city charter can require it sooner.

Yes, as long as your share of responsibility is not greater than 50 percent (Tex. Civ. Prac. & Rem. Code § 33.001). Your damages are reduced by your percentage. In a merge or lane-change crash on I-10, the truck’s dashcam and engine data often decide the percentage, which is why they are requested before they are overwritten.

Yes, through a wrongful-death claim, which must be filed within two years of the death (Tex. Civ. Prac. & Rem. Code § 16.003(b)). After a fatal crash, federal rules also require the carrier to test the surviving driver for alcohol and drugs (49 C.F.R. § 382.303). See our wrongful death page for who may bring the claim.

Not before your doctors know what treatment you will need and whether you can go back to the same work. A settlement ends the claim for good. Our truck accident settlement page explains what Texas law counts toward the value of a claim and what comes out of a settlement, including hospital liens.

Which Baytown roads and sites generate truck traffic?

Two highways and three freight sites. SH 146 and I-10 carry Baytown’s truck traffic; the ExxonMobil Baytown complex, TGS Cedar Port Industrial Park and the Port 10 Logistics Center near the Barbours Cut and Bayport terminals generate much of it. Each row below gives what the source itself says and when.

Which rules decide a Baytown truck accident claim?

Texas law sets the deadline and the fault rule; federal rules govern the truck. You generally have two years to sue, recover nothing above 50 percent responsibility, and face a six-month notice rule for a city or county vehicle. The carrier must follow federal driving-hour, testing and insurance rules.

What else do people ask after a Baytown truck crash?

Tap a question to open it.

Who investigates a truck crash in Baytown?

Inside the city limits, the Baytown Police Department; a City of Baytown news item describes its Crash Reconstruction Team investigating a major crash. On the August 6, 2025 SH 146 crash, the Harris County Sheriff’s Office also alerted drivers to the closure. Whichever agency responds writes the crash report and holds any body-camera footage, and both are requested early.

Why does SH 146 get so much truck traffic?

Because it is the north–south freight link along Baytown’s industrial waterfront. TxDOT states the highway is designated part of the Texas Highway Freight Network and names heavy vehicle traffic as one of the reasons it is studying the corridor from I-10 north through Baytown and Mont Belvieu, alongside safety concerns about fatal and incapacitating crashes.

What evidence matters most after a Baytown 18-wheeler crash?

The carrier’s records: the electronic logging device showing driving hours, the engine or event data showing speed and braking, the dashcam, the driver qualification file and the maintenance records. For a truck leaving a refinery or industrial park, the shipping papers and the facility’s gate records can show when it was loaded and when it left. Most of these are kept only for limited periods.

What if the truck was carrying chemicals from a Baytown plant?

Then higher federal insurance minimums usually apply, the shipper’s loading and paperwork become part of the case, and a spill can bring a hazmat response and separate cleanup claims. The carrier, not the plant, is usually the first defendant, but a shipper or loader whose own conduct contributed can share responsibility.

What if the truck driver was a contractor rather than an employee?

It does not by itself end the claim against the company that controlled the work. Who directed the driver’s dispatch, routes and safety compliance is decided on the facts of the case, which is why the lease, dispatch and payment records between the driver and the carrier are requested early.

Where will I be treated after a serious truck crash in Baytown?

Emergency crews decide. Houston Methodist Baytown Hospital at 4401 Garth Road is the city’s full-service acute care hospital, and Houston’s two Level I trauma centers, Memorial Hermann–Texas Medical Center and Ben Taub Hospital, are in the Texas Medical Center. For the claim, what matters is that every visit is documented from the first day.

How much is a Baytown truck accident case worth?

It depends on the injuries, the proof of fault, your own share of responsibility and the insurance behind each defendant. Texas limits medical damages to amounts actually paid or incurred and requires lost earnings to be shown after income tax. No honest lawyer can give a number before the medical picture is clear; the settlement page sets out every rule that moves it.

How much does it cost to hire a lawyer for a Baytown truck case?

Nothing up front. Maida Law Firm works on a contingency fee: a percentage of the recovery, set out in writing before you sign, and no attorney’s fee if there is no recovery. We handle Baytown cases from our Houston office on the Southwest Freeway and can meet by phone or video.
