GALVESTON CAR ACCIDENTS

Galveston Car Accident Lawyer

Maida Law Firm represents people injured in car crashes on Galveston Island, working from our Houston office on the Southwest Freeway; we do not have a Galveston office. TxDOT recorded 1,511 crashes inside the City of Galveston in 2025, 8 of them fatal. A Galveston car accident claim belongs to Galveston County, and Texas allows two years to file suit (Civil Practice and Remedies Code § 16.003(a)).

For a free review of your Galveston crash, call (713) 785-9484. Our fee is contingent: you owe nothing unless we recover money for you.

The short version

  • Galveston crashes inside city limits are reported to the Galveston Police Department (§ 550.026(a)), and a lawsuit usually belongs in Galveston County.
  • The at-fault driver may carry only $30,000 per person (§ 601.072). Your UM/UIM coverage stays in your policy unless it was rejected in writing (§ 1952.101(c)).
  • Fault of 50% or less does not bar recovery (§ 33.001); the general deadline to sue is two years (§ 16.003(a)).
  • We represent Galveston clients from our Houston office; there is no Galveston branch. Free consultation, contingency fee.
GALVESTON CRASH RECORD

How many car crashes happen in Galveston?

TxDOT’s city tables show 1,511 crashes inside the City of Galveston in 2025, 1,483 in 2024 and 1,718 in 2023. Each of those years had 8 or 9 fatal crashes. In 2025, 27 crashes caused a suspected serious injury and 196 a suspected minor injury; 1,132 were recorded with no injury.

The counts cover crashes located inside Galveston’s city limits (TxDOT, Crashes and Injuries — Cities and Towns, 2025; 2024; 2023; read October 28, 2026). For comparison, TxDOT’s county table puts all of Galveston County at 6,532 crashes in 2025, so roughly one in four of the county’s crashes happened in the island city.

Two of the island’s deadliest recent crashes involved drivers going the wrong way on its main roads. At about 1 a.m. on New Year’s Day 2025, a wrong-way driver collided with a family’s vehicle on Seawall Boulevard at 42nd Street; the wrong-way driver died and all four family members were taken to the UTMB Galveston emergency room, according to the Galveston Police Department (ABC13, January 1, 2025). On September 22, 2025, a 23-year-old UTMB nursing student was killed by a driver going the wrong way on Broadway; the Galveston County Sheriff’s Office later said that driver was charged with intoxication manslaughter (ABC13, November 25, 2025). A criminal charge is not a finding of civil liability, but the evidence gathered for it, including toxicology and scene reconstruction, often matters to the injury claim as well.

BUILDING YOUR CLAIM

What does a Galveston car accident lawyer handle for you?

We get the crash report and the scene evidence, document your treatment from the first emergency visit, identify every insurance policy that can pay, and file in Galveston County if the insurers will not pay fairly. The at-fault driver may carry only Texas’s minimum of $30,000 per injured person, which is why your own coverage often matters.

The report and the investigating agency. A crash with an injury, a death or a vehicle that cannot be driven safely must be reported at once to the local police department when it happens inside a city, and to the sheriff’s office or the nearest Department of Public Safety office outside one (Transportation Code § 550.026(a)). On the island that usually means the Galveston Police Department, based at the Joe Max Taylor Law Enforcement Center, 601 54th Street (City of Galveston). The investigating officer must file a written report within 10 days when a crash causes injury, death or apparent property damage of $1,000 or more (§ 550.062), and anyone involved in the crash, or that person’s authorized representative, can obtain it on written request and payment of the fee (§ 550.065(c)).

Medical records from day one. Seriously injured people on the island are often taken to UTMB’s Galveston emergency department, which UTMB describes as a Level I Trauma Center certified by the American College of Surgeons (UTMB Health). The emergency record is usually the first document an adjuster reads, so we make sure every later visit connects back to it.

Every policy, not just the other driver’s. Texas minimum liability limits are $30,000 for one person, $60,000 for two or more people and $25,000 for property damage (Transportation Code § 601.072(a-1)). Your own auto policy includes uninsured/underinsured motorist coverage unless a named insured rejected it in writing (Insurance Code § 1952.101(c)). When alcohol was involved, as alleged in the Broadway crash, our drunk driving accident page and our dram shop page explain when a bar or restaurant that served the driver can be part of the claim.

Fault and deadlines. Texas bars recovery only when your share of responsibility is greater than 50 percent, and reduces it by your percentage below that (Civil Practice and Remedies Code §§ 33.001, 33.012(a)). Suit must generally be filed within two years of the crash (§ 16.003(a)), and a claim involving a government vehicle can carry an earlier notice deadline.

For a crash with an 18-wheeler on I-45 or near the port, see our Galveston truck accident page. Injuries on the water or the docks are covered on our Galveston maritime and personal injury page, and the Houston car accident page describes how we handle car cases across the region. If a family member was killed, see our wrongful death page.

COMMON QUESTIONS

Galveston Car Accident Lawyer FAQs

Inside the City of Galveston, the Galveston Police Department, at 601 54th Street. Texas Transportation Code § 550.026(a) sends a crash report to the local police inside a city; outside city limits elsewhere in Galveston County it goes to the sheriff’s office or the nearest DPS office.

Request it from the agency that investigated, using the case number from the scene. The officer must file the report electronically with TxDOT within 10 days (§ 550.062(b)), and a person involved in the crash, or that person’s authorized representative, may obtain it on written request and payment of the fee (§ 550.065(c)).

Usually in Galveston County, where the crash happened. The Galveston County Courthouse is at 600 59th St, Galveston, TX 77551. A case is not filed in Harris County simply because our office is in Houston.

It does not change where the crash happened, so the claim usually still belongs in Galveston County. It can change which insurer handles it and how much coverage exists, so we ask for the other driver’s policy information early and check your own uninsured/underinsured motorist coverage as a backstop.

Yes, if your share is 50 percent or less. Civil Practice and Remedies Code § 33.001 bars recovery only above 50 percent, and § 33.012(a) reduces your damages by your percentage of responsibility.

Generally two years from the date of the crash (Civil Practice and Remedies Code § 16.003(a)). A claim against a city or county, for example over a government vehicle, can require written notice much sooner, so ask early.

No. Our one office is at 8313 Southwest Fwy Ste 102, Houston, and we represent Galveston clients from there. Most cases can be started by phone at (713) 785-9484.

There is no upfront cost. The consultation is free and we work on contingency, so no fee is owed unless we recover for you. The fee percentage is written into the agreement you review before signing.

Questions people ask after a Galveston crash

Tap a question to open it.

Are crashes in Galveston going up or down?

Down, by TxDOT's count: 1,718 crashes inside the city in 2023, 1,483 in 2024 and 1,511 in 2025, about 12 percent fewer in 2025 than in 2023. Fatal crashes held at 8 or 9 a year. TxDOT's tables do not give a reason for the change, so we do not offer one.

What should I do if a wrong-way driver hit me on the Seawall or Broadway?

Get medical care first and tell responders everything that hurts. Then write down the time, direction of travel and any witnesses, and photograph the vehicles before they are towed. Wrong-way crashes often lead to a criminal investigation, and the toxicology and reconstruction from that investigation can be requested for the injury claim once it is available.

Can a bar be responsible if it served the drunk driver who hit me?

In limited circumstances, yes. Texas has a dram shop law under which a business that served alcohol to the driver can be part of the claim, but the conditions are specific and the proof, such as receipts, staff accounts and video, has to be gathered early. Our dram shop page explains the requirements.

Who pays my medical bills right after a Galveston crash?

Often your own coverage pays first. Texas auto policies include personal injury protection unless a named insured rejected it in writing (Insurance Code § 1952.152(b)), and health insurance can also pay. The at-fault driver's insurer usually pays once, at settlement, so keep every bill and statement.

Should I give a recorded statement to the other driver's insurer?

We advise against it until you have spoken with a lawyer. What you say early, before the full extent of an injury is known, is often used later to argue the injury was minor.

When should I call a lawyer after a Galveston car accident?

As soon as you are able, and before the vehicles are repaired. Business and traffic camera footage can be overwritten within days, and a vehicle's stored crash data is lost once it is scrapped. The consultation is free.

Which court handles a Galveston injury case?

Galveston lies in one county — Galveston. A Texas injury suit is normally filed in the county where the crash or incident happened or where the defendant lives, so the courthouse that handles your case depends on which side of the county line you were on.
