THE WOODLANDS CAR ACCIDENTS

The Woodlands Car Accident Lawyer

If a car crash in The Woodlands left you or your family injured, Maida Law Firm can take the claim, working from our single office in southwest Houston. Montgomery County, where most of the township lies, logged 12,393 crashes in 2025 and 52 of them were fatal (TxDOT). An injury suit in Texas generally has to be on file within two years of the crash (Civ. Prac. & Rem. Code § 16.003(a)).

Phone (713) 785-9484 and we will review the Woodlands crash at no charge. Our fee is contingent: if there is no recovery, there is no fee.

The short version

  • Montgomery County, home to most of The Woodlands, had 12,393 crashes in 2025: 52 fatal and 287 with a suspected serious injury (TxDOT county tables).
  • The Woodlands is a township, not a city, so the Montgomery County Sheriff’s Office usually writes the report; Shenandoah and Oak Ridge North have their own police.
  • A minimum policy pays $30,000 toward one person’s injuries (§ 601.072); UM/UIM on your own policy covers more unless a named insured signed a rejection (§ 1952.101(c)).
  • A claim survives up to 50% shared fault (§ 33.001), and the usual filing limit is two years after the crash date (§ 16.003(a)).
  • We represent Woodlands clients from our Houston office; there is no Woodlands branch. Free consultation, contingency fee.
MONTGOMERY COUNTY CRASH DATA

How many car crashes happen around The Woodlands?

TxDOT does not publish a meaningful crash count for The Woodlands itself, because it is an unincorporated township, not a city: TxDOT’s 2025 city table lists just 3 crashes under that name. The useful figure is Montgomery County’s: 12,393 crashes in 2025, including 52 fatal crashes that killed 58 people and 287 crashes with a suspected serious injury.

The county count rose from 11,254 in 2023 to 12,352 in 2024 and 12,393 in 2025 (TxDOT, Crashes and Injuries by County, 2025; 2024; 2023; read October 27, 2026, Montgomery rows re-added October 28, 2026). Those totals include Conroe and the rest of the county, so they describe the roads a Woodlands driver uses rather than the township alone. TxDOT’s city table (2025) does count the two small cities on I-45 beside The Woodlands separately: 481 crashes in Shenandoah and 305 in Oak Ridge North in 2025.

The freeway is where the most dangerous crashes in this area tend to unfold, and secondary crashes are part of that risk. At about 2:39 a.m. on June 28, 2026, Montgomery County deputies were working a multi-vehicle crash near the Woodlands Parkway exit on I-45 North, which the sheriff’s office described as a DWI crash, when a commercial truck pulling a trailer struck and killed Deputy Erika Serrato and hit two patrol units (FOX 26 Houston, June 28, 2026). One driver from the first crash was charged with driving while intoxicated; the cause of the second collision was still under investigation when FOX 26 reported it.

YOUR WOODLANDS CLAIM

What does a Woodlands car accident lawyer do that an insurance claim alone does not?

We establish which jurisdiction the crash fell in, request the report from the agency whose officer wrote it, and trace each policy that could pay. Around The Woodlands that work matters more than usual: the township, two counties and two small cities on I-45 all meet within a few miles, and the at-fault driver may carry only $30,000 per injured person.

The right agency and report. Texas sends the first call to the city police inside a municipality and to the sheriff or the nearest Department of Public Safety office elsewhere (Transportation Code § 550.026(a)). Most of The Woodlands has no city police; The Woodlands Township states that law enforcement is a county responsibility and funds added patrols through the Montgomery County Sheriff’s Office and Harris County Constable Precinct 4 (The Woodlands Township). The sheriff’s District 6 primarily patrols the township, about 44 square miles, from 9200 Grogan’s Mill Road, while District 2 surrounds it and contains the cities of Oak Ridge North and Shenandoah (Montgomery County Sheriff’s Office). A crash inside one of those cities goes to that city’s police department instead. Whoever investigates has 10 days to file a written report if the crash injured anyone or caused apparent property damage of $1,000 or more (§ 550.062).

Every policy behind the other driver. The floor Texas sets for liability insurance is $30,000 per injured person, $60,000 per crash when two or more are hurt, and $25,000 for property (Transportation Code § 601.072(a-1)). Your own uninsured/underinsured motorist coverage stays in the policy unless someone named on it signed a written rejection (Insurance Code § 1952.101(c)), so we read your declarations page before anyone tells you the coverage is not there. When a drunk driver caused the crash, the criminal case and your injury claim run separately: a DWI charge is not compensation, and the claim still has to be built and filed.

Fault and the deadline. A jury finding that puts more than half the blame on you ends the claim (Civil Practice and Remedies Code § 33.001); a smaller share only trims the award by that percentage. The filing deadline for most injury suits is two years from the crash date (§ 16.003(a)).

Serious injuries from Woodlands crashes are often treated at Memorial Hermann The Woodlands Medical Center, 9250 Pinecroft Drive, which describes itself as a designated Level II trauma center (Memorial Hermann). For a crash with an 18-wheeler on I-45, see our Woodlands 18-wheeler and truck accident page; for county, notice and non-crash injury questions, our Woodlands personal injury page. The Houston car accident page explains how we handle car cases across the region, and our drunk driving victims page covers claims against impaired drivers.

COMMON QUESTIONS

The Woodlands Car Accident Lawyer FAQs

Usually the Montgomery County Sheriff’s Office, because most of The Woodlands is unincorporated and has no city police department. DPS troopers also work the highways, Harris County Constable Precinct 4 serves the Harris County side, and a crash inside Shenandoah or Oak Ridge North goes to that city’s police. The case number given at the scene tells you which agency it was.

Because TxDOT’s city tables count crashes inside incorporated cities, and The Woodlands is a township rather than a city. Its 2025 city row shows only 3 crashes. Crashes on Woodlands streets are counted in the county totals instead: 12,393 in Montgomery County in 2025.

Normally one in the county where the collision occurred. For the Montgomery County side that means a district court in Conroe, in either the 207 West Phillips or the 301 North Main building; for the Harris County side, the Civil Courthouse at 201 Caroline St in Houston.

A minimum Texas policy pays at most $30,000 toward one person’s injuries (Transportation Code § 601.072(a-1)). The gap above that can come from your underinsured motorist coverage, which is included unless a named insured turned it down in a signed writing (Insurance Code § 1952.101(c)).

Usually, yes. Texas only bars the claim when the injured person is found more than 50 percent responsible (§ 33.001); at 50 percent or under, the damages award is cut by whatever percentage is assigned to you (§ 33.012(a)).

For most injury claims the limit is two years, counted from the crash (§ 16.003(a)). If a county, township or other public vehicle was part of the crash, a written notice deadline arrives far earlier, so raise that question in the first weeks.

No. Our only office is 8313 Southwest Fwy Ste 102, Houston, TX 77074. Woodlands clients usually begin with a phone call to (713) 785-9484, and after that we meet by video, by phone or in person, whichever suits the client.

You pay nothing to start. The first consultation is free, the fee is a percentage of what we recover, and if nothing is recovered you owe no fee. That percentage is spelled out in the written agreement you read before signing.

Who takes the report, and which courthouse hears a Woodlands crash case?

The crash location settles both questions. Texas routes the report to a city’s police inside its limits and to the sheriff or nearest DPS office outside them (§ 550.026(a)). Suits normally go to the county where the collision happened: Montgomery or Harris, around The Woodlands.

Questions people ask after a Woodlands crash

Tap a question to open it.

Why do Montgomery County crash numbers matter for a Woodlands claim?

Because they are the closest official count of the roads Woodlands drivers use, and TxDOT has no city-level figure for the township. They also show what kind of crashes dominate: in 2025, 8,716 of the county’s 12,393 crashes were non-injury crashes. Many injury claims start in that category, when neck or back pain shows up days after a crash first recorded as property damage only.

What changes if the driver who hit me was arrested for DWI?

The arrest helps prove fault, but it does not pay your bills. The criminal case belongs to the State; your injury claim is a separate civil claim against the driver and that driver’s insurer, with its own two-year deadline. Ask the agency for the report and keep the case number, because the arrest records and any test results are evidence for the civil claim too.

What should I do if I am hit again while stopped after a crash on I-45?

Treat it as a second crash with its own driver and insurer, and say so to the officer so both impacts are in the report. Secondary crashes on I-45 near The Woodlands can be more serious than the first one, as the June 2026 crash at the Woodlands Parkway exit showed. Each driver who caused an impact can be responsible for the injuries that impact caused.

Who pays my medical bills right after a Woodlands crash?

Often your own policy, through personal injury protection. PIP is included in a Texas auto policy unless someone named on it declined it in writing (Insurance Code § 1952.152(b)), and its benefits are payable without regard to fault (§ 1952.155(a)); health insurance may also pay. Money from the other driver’s insurer typically arrives in one payment when the claim settles, which is why every bill and receipt should be saved from day one.

When should I call a lawyer after a car crash in The Woodlands?

Before you give a recorded statement to the other driver’s insurer and before either vehicle is repaired or sold for salvage. Both steps are permanent, and both are where claims most often lose value. The consultation costs nothing, so an early call carries no downside.
